Rental Policies

Payments:

Personal checks or credit cards are acceptable forms of payment. A payment of one half the total rent will reserve the property. A lease will be emailed or mailed which must be signed and returned. All charges to include rent, service fees, rental tax, any insurance charges or security deposits are due May 1st. Reservations made after May 1st will require payment in full by credit card or bank check.

Taxes: there will be a calculated state tax for each lease which represents a state tax of 5.7%, plus a Cape Cod Water Protection Fund of 2.75%, and an additional 6% for the towns of Dennis, Yarmouth, Barnstable and Brewster. Harwich charges 4%. 

There is a service charge per rental of $150 and a hosting fee of 7.5%. 
 

Cancellation:

If cancellation is requested 90 or more days from check in date on the rental, we will refund your initial payment minus the service charge. If we receive notice of cancellation 89 days or less, we will not make any refund unless ERA Cape Real Estate is able to find another tenant for the property with the same terms and conditions. At no time will there be any substitutions on properties at check in.   
 

Security Deposits:

Security deposits, as stipulated on the listing sheet and on the lease, are due with the final payment on May 1st. It is stipulated on the listing sheet and/or disclosed on the lease if the owner requires a Security deposits over and above our damage waiver. Security deposits can be used by the owner to repair damage or replace missing items for which the tenant is responsible, or for EXCESSIVE CLEANING fees. The landlord cannot apply the security deposit to normal wear and tear. Normal wear and tear includes deterioration of the premises that occurs during normal conditions. Damage occurs from unreasonable use or accidents. It is our policy to return Security Deposits within three weeks after the departure date and only after we have verified there are NO missing items, damages, or excessive cleaning required after check-out.


Damage Waiver Program:

We offer a damage waiver fee of $75. This protects you for up to $1,000.00 worth of damage protection during your lease period. This will protect you from accidental damage expenses, which result from an accident within the rental due to your inadvertent acts or omissions. The Damage Waiver Fee does not cover normal wear and tear, nor any negligent, willful and wanton conduct. This Protection will not be available to you unless you notify ERA Cape Real Estate LLC of any damage to the unit when you assume occupancy or during your occupancy. Your credit card may also be billed for any excess damages. Some owners may require a security deposit instead of or in addition to the Damage Waiver Fee.
 

Occupancy:

Occupancy, including small children and infants, and visitors is not to exceed the limit cited on the Lease. If more than the maximum is found to be occupying the leased property, the Lease may be immediately terminated without refund and the Security Deposit forfeited.

Pets:

No pets are allowed in any property unless permission is granted by the Landlord and reflected in the lease. There may be an additional security deposit required.

Accommodations:

All of our properties are NON SMOKING and are privately owned and reflect the tastes of each owner. The listing sheet on the property should accurately reflect the description of the property HOWEVER if you do not personally inspect the premises, ERA Cape Real Estate will not be held liable for any missing information or inaccuracies of description. We ask all tenants to bring with them anything that they cannot live without, because it may be that this particular house does not have whatever that is. If you have a specific type of coffee pot for your morning coffee – bring it with you or be willing to make do with what the owner has provided. There should be adequate kitchen utensils and appliances. There will be blankets and pillows and furnishings as represented on the listing sheet. Internet is provided at all properties, unless noted, however ERA Cape Real Estate is NOT responsible for outages or interrupted service.

If the cleaning crew for any property is late in arriving to your rental, there will be no adjustment to rent unless the property is unavailable after 6:00 pm.

TENANTS ARE RESPONSIBLE FOR BRINGING THEIR OWN SHEETS AND TOWELS.

Some houses have beach chairs for tenants to use.


Check In and Check Out:

Check in is from 3:00 pm to 5:00 pm. Check out is at 10:00 am. There are no exceptions. If you plan on checking in after 5:00 pm, please call the office and we will make arrangements.
 

Internet:

Many of our properties offer Internet access. Internet connections are not guaranteed. No refunds will be given for Internet access problems. Additional charges may apply for Internet technical support due to issues not related to the property’s internet access, including but not limited to guest computer errors in configuration.

Construction during your stay:

Refunds are not provided for noise or other annoyances such as construction when the source is another property not owned by the owner of the property you have rented.

Allergies/Environmental Sensitivities:

Mid Cape Rentals cannot guarantee that a specific humidity, temperature or hypoallergenic condition can be maintained within the property. Nor can we guarantee the absence of environmental allergens (including pet dander and smoke) in any of our rental properties.
